á la carte Terms and Conditions

These Terms and Conditions govern the operation of the A la Carte Programme ( ' Programme ' ). All Members are subject to these Terms and Conditions and are deemed to have read and understood them. These Terms and Conditions are effective as at the date of publication 01 April 2008 and may be amended from time to time.

GENERAL

Millennium, Copthorne & Kingsgate Hotels and Resorts reserve the right at all times to make any changes to the Programme, including but not limited to the Terms and Conditions, Membership fees, the participating Hotels / Resorts, the benefits offered under the Programme, blackout periods and the Terms and Conditions attached to complimentary night and/or accommodation certificates/vouchers. Millennium, Copthorne & Kingsgate Hotels and Resorts will not be liable for any loss or damage suffered by any Member as a result of any such changes and will not be liable in any way for any failure to notify Members of any changes. Millennium, Copthorne & Kingsgate Hotels and Resorts gives no warranty as to the continuing availability of the Programme and reserves the right to terminate or suspend the Programme at any time.

Millennium, Copthorne & Kingsgate Hotels and Resorts exclude, to the maximum extent permitted by law, all express or implied warranties of any kind in relation to any information or materials relating to its hotels and resorts or the Programme or these Terms and Conditions and any other liability, including any and all consequential losses or damages from any provision or non-provision of goods and services including, but not limited to, the type, quality, standards and fitness of such goods or services.

These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand .

MEMBERSHIP AND MEMBERSHIP CARD

Purchase of memberships is open to persons over the age of 18 years only.

Persons or organisations wishing to become Programme Members must apply for membership and pay the applicable fees. Membership is offered at the discretion of Millennium, Copthorne & Kingsgate Hotels and Resorts. Millennium, Copthorne & Kingsgate Hotels and Resorts may accept or reject any application for membership at its sole discretion. Membership is valid for a 12 month period following the joining date or renewal thereof. Programme Members must advise á la carte of any change of name, address, or other details.

The á la carte Membership Card ('Card')

a) is the property of Millennium, Copthorne, Kingsgate Hotels & Resorts at all times and must be returned on demand;

b) may only be used by the Member and is not transferable in any way;

c) may only be used until the expiry date on the Card;

d) must be presented at check-in to confirm membership status;

e) is not a payment card.

By using the Card the Programme Member agrees to be bound by these Terms & Conditions. If a members Card is lost or stolen or is subject to unauthorised use, the member must advise a la carte membership as soon as possible. A fee may be charged for a replacement Card.

Programme Members may terminate their membership by returning the Card unsigned and the unused membership pack (including all certificates) to the a la carte membership office within 14 days of joining the Programme. A refund of the membership fees (less an administration charge of $25) will be provided. No refunds will be made if cancellation is made after 14 days of joining the Programme.

Millennium, Copthorne, Kingsgate Hotels & Resorts reserves the right to suspend or terminate the Membership of any Programme Member and/or the right of any Programme Member to use the Card or any benefit or Certificate at any time at its absolute discretion. Millennium, Copthorne, Kingsgate Hotels & Resorts will not be liable for any loss or damage suffered by any person or organisation as a result of such suspension or termination.

ACCOMMODATION BENEFITS
Any accommodation discount shall not apply to any rates which may be obtainable from sources other than the a la carte Reservations Centres such as but not limited to travel/hotel websites or travel agents, and does not apply to group bookings or package rates, incentive or conference packages or special or promotional rates which may apply from time to time. Millennium, Copthorne, Kingsgate Hotels & Resorts reserves the right to alter or amend the rates for all its hotels and resorts at its absolute discretion and does not in any way represent, warrant or guarantee that the best available rate for a la carte Reservations Centre at the time a reservation is made will continue to be the best available rate after thereservation is made and Millennium, Copthorne, Kingsgate Hotels & Resorts will not be liable for any loss or damage which may be suffered by any person or organisation as a result of any amendment or alteration of any of its rates at any time.

The value of the membership benefits / estimated savings to members is the difference between the rates available through a la carte programme and standard discounted rates usually available to general public.

To qualify for the a la carte accommodation exclusive offers, Programme Members must make all reservations directly to www.clubalc.co.nz or freephone 0800 CLUB ALC (2582 252). Reservations made through other websites or Travel agents will not be accepted under the promotion. Reservations made using any á la carte accommodation discount do not qualify for attract airline frequent flyer points. The a la carte accommodation discounts cannot be used in conjunction with any other Millennium, Copthorne, Kingsgate Hotel & Resorts loyalty programme, 10 Stay Free Card, or any other discounts, specials, certificates, packages or promotional offers and does not apply to charges relating to accommodation (e.g. room service, in-room movies) which must be settled at check out.

Complimentary Night & a la carte Accommodation Vouchers
Conditions of use relating to the complimentary night & a la carte accommodation vouchers are printed on the reverse of the respective vouchers. Such conditions of use are in addition to these General Terms and Conditions of the Programme and both must be read together. No replacement vouchers will be issued if lost or stolen. Vouchers may not be used for group, incentive or conference bookings.

Availability of rooms is limited and will depend on hotel, location, season and demand. Millennium, Copthorne, Kingsgate Hotels & Resorts limits the availability of rooms at their absolute discretion and does not guarantee that accommodation is or will be available on any particular dates at its hotels. The term standard double or twin or single room implies a maximum occupancy of 2 adults per room.


DINING BENEFITS

Programme Members may also receive food & beverage benefits at participating hotels which are managed or franchised by Millennium, Copthorne, Kingsgate Hotels & Resorts New Zealand. Programme Members may receive a discount of twenty (20) percent off all food and beverage (with up to a maximum of 4 guests) purchased for consumption within participating Millennium, Copthorne, Kingsgate Hotels & Resorts in New Zealand . Programme Members must present their Card on arrival at the restaurant or bar in order to receive the food & beverage discount and must order items from the bar/restaurant's regular menu and wine/beverage list. The Food & Beverage discount cannot be used in conjunction with any other discounts, specials, certificates, packages or promotional offers and does not apply to banqueting, mini bar charges or bottle-shop sales and is not available on Christmas Day and New Year's Eve.

Participating restaurants are subject to change without notice.

Millennium Hotels and Resorts does not condone the excessive consumption of alcohol or driving while intoxicated and encourages members to take appropriate measures to ensure that they and their guests are able to enjoy themselves responsibly and get to and from home and our hotels safely.

Collection and use of your personal information is subject to applicable laws, including the Privacy Act 1993 ( New Zealand ). You have the right to access your personal info rmation recorded by Millennium, Copthorne, Kingsgate Hotels & Resorts and update or correct your personal information.
